1. Overview
This website is operated by malhcha.inc.
Throughout the site, the terms “we”, “us” and “our” refer to malhcha.inc.
By visiting our site and/or purchasing from us, you agree to be bound by these Terms of Service.
2. Products
All products are subject to availability.
Due to the handmade nature of Onggi products, variations in shape, color, and texture are natural and are not considered defects.
Matcha products are consumable goods and are not eligible for return once opened.
3. Orders & Payment
We reserve the right to refuse or cancel any order at our sole discretion, including but not limited to suspected fraud or unauthorized transactions.
4. Shipping
All orders are shipped from South Korea to international destinations, including the United States and Canada.
Delivery times are estimates only and may vary due to customs clearance and carrier delays.
We are not responsible for delays outside of our control.
5. Customs, Duties & Import Fees
Customers are responsible for any applicable customs duties, taxes, or import fees.
Failure to pay such fees may result in delays or return of the shipment, and all associated costs shall be borne by the customer.
6. Returns & Refunds
Please review our Refund Policy before making a purchase.
We reserve the right to deny returns that do not comply with our policy.
7. Limitation of Liability
To the fullest extent permitted by applicable law, malhcha.inc shall not be liable for any indirect, incidental, or consequential damages arising from the use of our products or services.
Each Onggi is handcrafted from natural clay and should be handled with care.
If an Onggi becomes chipped, cracked, or broken, discontinue use immediately. Broken ceramic pieces may have sharp edges and can cause injury if handled improperly.
MALHCHA is not responsible for injuries, damages, or losses resulting from the misuse, mishandling, continued use of damaged products, or improper disposal of broken ceramic pieces.
8. Chargebacks & Disputes
By completing a purchase, you agree to contact us first to resolve any issue before initiating a chargeback or dispute.
Unauthorized chargebacks may be contested with supporting evidence, including order confirmation, shipment tracking, and proof of policy acceptance.
9. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario and the applicable federal laws of Canada.
Any disputes arising under these Terms shall be resolved exclusively in the courts located in Ontario, Canada.
10. Changes to Terms
We reserve the right to update or modify these Terms at any time.
Continued use of the site following any changes constitutes acceptance of those changes.
